Renting in Denver with an assistance animal

Denver has about 741,000 residents and grew 3.5 percent between 2020 and 2025. It is a consolidated city and county, which means one set of local rules for the whole jurisdiction, and a rental market dominated by large purpose-built apartment buildings along the light rail corridors and in the newer districts.

Professionally managed buildings

RiNo, LoHi, Cherry Creek, Union Station and the Golden Triangle are full of buildings run by regional management companies. That generally helps you: there is a written accommodation process, staff have handled requests, and decisions follow policy rather than mood.

The friction point is fees. Amenity-heavy Denver buildings routinely attach monthly pet rent and a pet deposit, and an approved assistance animal is exempt from both. Raise the accommodation before you sign. Removing charges from a ledger afterwards is slower than never having them applied.

The 2026 state law works in your favour here

Since HB26-1045 took effect in August 2026, a Denver landlord cannot treat your animal's mere presence as a threat or presume it will damage the property. Those were the two most common refusals. A provider who wants to refuse now has to point at documented, specific conduct.

Older housing and small landlords

Baker, Capitol Hill, Congress Park and Park Hill hold a great deal of subdivided older housing owned by individuals. Blanket no-pet clauses written years ago are common there and do not defeat a request, but you may well be the first tenant to raise one with that owner. Short, written and calm works better than citing statutes.

We write for tenants in Capitol Hill, Baker, RiNo, Five Points, Highlands, Berkeley, Washington Park, Cherry Creek, Stapleton and Central Park, Green Valley Ranch and Montbello.

The 2026 law that changed this

Colorado signed HB26-1045 in June 2026 and it took effect that August. It wrote emotional support animals into the Colorado Anti-Discrimination Act as assistance animals, and stated that an assistance animal's mere presence is neither a direct threat nor presumed to cause property damage. Colorado also requires a bona fide provider-patient relationship before an ESA letter is issued, so a genuine evaluation is not optional here. Both are covered in full on our Colorado ESA laws page.

Denver ESA letter questions

Can my Denver apartment charge pet rent for my ESA?

No. An approved assistance animal is not a pet, so pet rent, deposits and breed fees do not apply. Request the accommodation before signing so the charge is never applied. If it is charged anyway, the Colorado Civil Rights Division takes complaints.

Do Denver landlords accept online ESA letters?

Many do, provided a Colorado-licensed clinician actually evaluated you. Colorado requires a bona fide provider-patient relationship, so instant-approval documents are exactly what a Denver property manager will challenge.

My landlord says my dog is a liability risk. Is that allowed?

Not on presence alone. Since HB26-1045 the mere presence of an assistance animal is neither a direct threat nor presumed to cause substantial property damage. A refusal needs documented, specific conduct.

How fast can I get a letter in Denver?

Same day in most cases. Appointments run seven days a week from 7 AM to 11 PM Mountain time, and an approved letter is emailed within 15 minutes of signing.
